Handmade Guidelines
Introduction Touch of Artisan is a marketplace dedicated to U.S.-based artisans, offering a platform to showcase and sell their handmade products. We employ an application process to ensure our customers can trust the authenticity of the handmade items available.
Enforcement of Handmade Integrity If any seller is found to be offering non-handmade items, Touch of Artisan reserves the right to take legal action to protect the marketplace's integrity. If you are uncertain about whether your products qualify as handmade, please reach out for clarification.
Seller Requirements To become a seller on Touch of Artisan, the following criteria must be met. Touch of Artisan retains the right to revoke selling privileges at any time and to update these guidelines as needed.
Definition of Handmade On Touch of Artisan, "handmade" refers to items created through a personal, hands-on process, resulting in unique products that differ significantly from the raw materials used. The seller must be actively involved in the creation of each product.
Handmade Criteria
- Products must be made by the seller or a small team of family members or employees.
- Mass production and outsourcing of production are not allowed.
- Use of hand tools and light machinery is permitted, provided they are used in the seller's personal workspace or a shared maker space.
- External printing is allowed for items like art prints if the seller designs the product and oversees the final production steps, including shipping.
- Sellers can hand-alter pre-made items, such as applying designs to blank t-shirts or mugs, and can upcycle existing products.
- Due to payment processor regulations, products containing cannabis or its derivatives are not allowed.
Images, Language, and Adult Content Touch of Artisan aims to create a comfortable environment for all shoppers. While we value artistic expression, we maintain a family-friendly platform. Products should generally be rated "PG-13," with mild profanity allowed if appropriately censored. Explicit language and hate speech are prohibited. Nudity is acceptable if it is tastefully presented as part of an artistic piece, but models showcasing other items must be appropriately clothed.
Prohibited Products
- Drop-shipped or print-on-demand items, except for prints of original artwork handled by the artist.
- AI-generated art and designs are not allowed to ensure the platform supports genuine handmade craftsmanship.
Digital Items: Digital products like digital art, graphics, templates, and patterns are allowed, provided they are original works and do not infringe on others' intellectual property rights.
Gift Baskets and Kits: Gift baskets and kits must primarily feature handmade items. If the handmade component is not the main attraction, the product may not be listed.
Food and Consumables: Food products are allowed under strict guidelines, such as prohibiting raw meat, hatching eggs, alcohol-containing products, and CBD. Sellers must comply with all relevant laws and assume full responsibility for their products.
Plants: Plants can be sold if they are part of a handmade item, arrangement, or dried art piece. Single plants, clippings, bulbs, and seeds not incorporated into handmade items are not permitted.
Lapidary Rocks and crystals can be sold if they are mined, treated, or artistically altered by the seller. Unaltered rocks are not allowed.
Animal Products and Taxidermy: Items made from animal products must comply with ethical standards and legal requirements. The sale of items from endangered species, pets, and ivory-producing animals is prohibited.
Cremated Remains and Ashes: Custom memorial products with cremains are allowed, provided they comply with USPS shipping regulations.
Services Services can be offered if they result in a tangible product. Divination, metaphysical, ritual, rental, and personal information services are not permitted.
Charitable Activities: Sellers can support charitable organizations, but must include a tangible product in each listing. Sellers must clearly state the charity they support and obtain consent if using the organization's name and trademark.
Crowdfunding and Money Transfers: Listings cannot be used solely for money transfers or crowdfunding.
Intellectual Property: Sellers must have the necessary rights to list and sell their products and respect the intellectual property of others.
Information Sharing: By listing on Touch of Artisan, sellers agree that their information, including images, can be shared across Touch of Artisan's platforms for promotional purposes.
Independent Sellers: Sellers are independent contractors and not employees of Touch of Artisan, LLC.
Sales Guarantee: Touch of Artisan (TOA) does not guarantee any sales of artisans' handmade products.
Shipping Responsibilities: Sellers are responsible for accurately calculating shipping costs and ensuring that products sold through TOA are shipped in a timely manner.
Tax Reporting: TOA will provide an annual Form 1099-NEC if a seller's total sales, including shipping fees, reach $5,000 or more. Regardless of the amount, sellers are required to file an annual income tax return based on their actual sales and pay their own income taxes. TOA’s responsibilities include reporting total sales to sellers and providing a Form 1099-NEC if total sales are $5,000 or more for the fiscal year. (Note: The Internal Revenue Service also receives a copy of all issued 1099s.
