Prohibited Items: Dropshipping, Print-on-Demand, and Copyright-Infringing Products

1. Overview

Our marketplace showcases and sells handmade products crafted by individual artisans. To maintain the integrity and quality of the market, the following items are strictly prohibited:

• Dropshipping items: Products sold by a vendor but fulfilled and shipped by a third party without the vendor's direct involvement in the production or handling.
• Print-on-Demand items: Products created and shipped directly to the customer by a third party after the order is placed, without the vendor’s direct involvement in the creation process.
• Copyright-Infringing Products: Items that violate the intellectual property rights of others, including but not limited to reproductions of copyrighted works, trademarked items, and any other unauthorized use of intellectual property.
  
  

2. Definition and Scope

• Dropshipping: Dropshipping is defined as a supply chain management method where the seller does not keep the products it sells in stock. Instead, the seller transfers the customer's order and shipment details to either the manufacturer, another retailer, or a wholesaler, who then ships the goods directly to the customer.

• Print-on-Demand: Print-on-demand refers to products that are printed, produced, and shipped by a third-party service only after a sale is made. This includes but is not limited to apparel, home decor, and custom merchandise.

• Copyright-Infringing Products: Copyright infringement refers to the unauthorized use of copyrighted material in a way that violates the copyright holder's exclusive rights. This includes:

  • Reproductions or imitations of original artworks.
  • Use of trademarked logos, names, or designs without permission.
  • Any item that violates the intellectual property rights of others.
    
    

3. Consequences of Violation

Vendors found to violate this policy will face the following consequences:

• Immediate removal of the non-compliant listings.
• A warning issued to the vendor.
• Repeated violations will result in suspension or termination of the vendor's account.
  
  

4. Reporting Non-Compliance

We encourage all users to report any suspected violations of this policy. Reports can be submitted through our contact form, and we will investigate all claims thoroughly.

Handmade Products Requirement

1. Overview

Our marketplace is committed to providing a platform for genuine handmade products crafted by individual artisans. To maintain the authenticity and quality of the items sold, we require that all products listed on our marketplace must be handmade by the vendors themselves.

2. Definition of Handmade Products

• Handmade Products: Items that are created and crafted manually by the artisan without the extensive use of automated machinery or mass production techniques. Each item should reflect the artisan's skill, craftsmanship, and creativity.
  
  

3. Criteria for Handmade Products

To qualify as handmade, products must meet the following criteria:

• Personal Involvement: The vendor must be personally involved in the making process of each item. This includes designing, crafting, assembling, and finishing the product. Outsourcing the production process to third parties is strictly prohibited.

• Artisanal Techniques: The creation process should involve traditional or contemporary handcrafting techniques. This can include, but is not limited to, sewing, knitting, painting, carving, sculpting, weaving, and similar methods.

• Limited Use of Machinery: While some tools and equipment may be used to aid the crafting process, the primary production should not rely on automated machinery or mass production methods. The use of such equipment should be minimal and secondary to the handmade process.

• Original Designs: Products should be original designs or significant adaptations of existing designs. Reproductions or imitations of mass-produced items do not qualify as handmade.
  
  

4. Prohibited Practices

• Mass Production: Products that are produced in large quantities using automated machinery or assembly lines are not allowed.

• Outsourcing: Any items that are outsourced to third parties, including factories or other artisans, for production are prohibited.

• Unaltered Commercial Products: Selling unaltered commercial products, even if they are assembled by hand, is not permitted. Each product should exhibit a unique touch of the artisan’s creativity and effort.

Sales Disclaimer and Promotion

Touch of Artisan is dedicated to supporting and promoting our community of handmade artists. We invest in paid advertisements and promotional activities to increase visibility for our marketplace and its vendors. However, we do not guarantee sales for any vendor.

2. Promotional Activities

• Paid Advertisements: Touch of Artisan will invest in various forms of paid advertising, including but not limited to social media ads, search engine marketing, and display ads, to attract potential buyers to the marketplace.

• Marketing Campaigns: We will run marketing campaigns aimed at highlighting the unique and high-quality products available from our vendors. These campaigns may include email newsletters, social media posts, blog features, and other marketing strategies.

3. No Guarantee of Sales

• No Sales Guarantee: Despite our best efforts to promote the marketplace and its vendors, Touch of Artisan does not and cannot guarantee that any vendor will achieve a specific number of sales, or any sales at all.

• Market Conditions: Sales can be influenced by a variety of factors, including but not limited to market conditions, consumer preferences, competition, pricing, and the quality and appeal of the products themselves. These factors are beyond our control.

4. Vendor Responsibilities

• Product Quality and Appeal: Vendors are responsible for ensuring that their products meet high standards of quality and appeal. This includes providing accurate descriptions, high-quality images, and fair pricing.

• Active Participation: Vendors are encouraged to actively participate in their own marketing efforts, such as promoting their shops and products through their personal social media channels, blogs, and other platforms.

• Customer Service: Providing excellent customer service, including timely responses to inquiries and prompt shipping, can significantly impact sales and customer satisfaction.

5. Reporting and Feedback

• Performance Reports: Touch of Artisan may provide vendors with performance reports that include data on views, clicks, and other relevant metrics. These reports are intended to help vendors understand how their products are performing and identify areas for improvement.

• Feedback and Support: We welcome feedback from our vendors on how we can improve our promotional efforts. Vendors can contact our support team with any suggestions or concerns.

6. Disclaimer

• Limitation of Liability: Touch of Artisan shall not be held liable for any loss of revenue, profits, or any other damages resulting from the lack of sales or performance of any vendor’s products. By participating in the marketplace, vendors acknowledge and accept this risk.
